1. Who these terms are with
This website is operated by Carl Guinney trading as Bexus Systems, a software and systems business based in Bristol, United Kingdom. "We", "us" and "our" refer to that business. "You" refers to anyone using this website.
By using this website you accept these terms. If you do not accept them, please do not use the site.
2. What this website is
This site describes services we offer and work we have done. Everything on it is provided for general information. It is not professional, technical or legal advice, and it is not an offer capable of acceptance. Nothing here creates a contract to supply services.
3. Accuracy and availability
We take reasonable care to keep the content accurate and current, but we do not warrant that it is complete, error-free or up to date. Case studies describe outcomes achieved for particular clients in particular circumstances; they are not a promise of similar results for you.
We aim to keep the site available, but we do not guarantee uninterrupted access. We may change, suspend or withdraw any part of it without notice.
4. Intellectual property
Unless stated otherwise, the content, design, code, branding and logos on this site belong to us or are used under licence. You may view, download and print pages for your own reference or to evaluate our services.
You may not republish, sell, sub-licence or systematically extract material from this site without our written permission, or use our name or logo in a way that suggests endorsement or a relationship that does not exist.
5. Links to other sites
Where we link to a third-party website, that link is for convenience. We have no control over those sites and accept no responsibility for their content, availability or privacy practices.
6. Acceptable use
You agree not to use this site:
- In any way that breaches applicable law or regulation
- To transmit malware, or to attempt to gain unauthorised access to it or its hosting
- To scrape or harvest data in a way that places unreasonable load on the service
- To send unsolicited commercial messages through the contact form
7. Enquiries and submissions
If you send us an enquiry, you confirm that the information you give is accurate and that you are entitled to share it. Please do not send confidential or sensitive material through the contact form before we have agreed how it will be handled. Personal information is dealt with as set out in our privacy policy.
8. How paid work is contracted
These website terms do not govern paid work. Each engagement is set out in a separate written proposal or statement of work, which takes precedence over anything on this site. As a rule, that document will cover:
- Scope and deliverables — what is included, and what is explicitly not
- Price and payment terms — normally a fixed price per defined slice of work, invoiced against agreed milestones
- Timescales — target dates and what they depend on from your side
- Intellectual property — on full payment, ownership of the bespoke source code and data produced for you transfers to you; third-party and open-source components remain under their own licences
- Data protection — where we process personal data on your behalf, the controller/processor terms required by UK GDPR
- Support and hosting — service levels, response times and notice periods, where those are part of the engagement
- Change control — how changes to scope are priced and agreed before work starts
Quotes are valid for 30 days unless stated otherwise. Late payment may attract statutory interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998.
9. Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
Subject to that, we exclude all implied warranties in relation to this website, and we are not liable for any loss of profit, loss of business, business interruption, or loss of data arising from your use of, or inability to use, this website. Liability arising from paid work is governed by the relevant engagement contract.
If you are using this site as a consumer, these terms do not affect your statutory rights.
10. Changes to these terms
We may update these terms from time to time. The version published on this page at the time you use the site is the version that applies. This version was last updated on 7 August 2026.
11. Governing law
These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
